Code of Conduct for Mediators of International Commercial Mediation Center for the Belt & Road

I. A mediator shall, perform its duties with due diligence and prudence, and settle the disputes through mediation in an independent, impartial, efficient and confidential manner, in accordance with the rules of the International Commercial Mediation Center for the Belt&Road Initiative.

II. A mediator shall be independent and impartial, not representing either party, performing his duties without preconceptions and biases, and shall not liaise with either party and seek to be appointed as mediator of a case.

III. A mediator should receive regular training from mediation center, have a high level of theoretic knowledge of mediation and rich experience of practice in mediation practice.

IV. When a mediator accepts the designation of the parties or the mediation organization, he or she shall ensure the time and energy necessary for mediation. The mediator shall voluntarily disclose to the mediation organization any circumstances which may be deemed to challenge his independence and impartiality. If the circumstances hereof may prevent the case from being heard in an impartial manner, he or she shall not serve as the mediator of the case, unless otherwise agreed by the parties.

V. A mediator shall not, in the course of mediation of a case, have any speech or act contrary to the principle of independence and impartiality.

VI. A mediator shall comply with the obligation of confidentiality and shall not disclose any information about the substance or procedure of the case.

VII. After mediation proceedings, whether the mediation is successful or not, a mediator shall not serve as the arbitrator or representative of either party in any subsequent arbitration or proceedings.

VIII. This rule shall be taking into effective as of the date of issuance. The rule shall be interpreted by the International Commercial Mediation Center for the Belt & Road Initiative.
